RESERVATION FOR THE POOR AMONG THE FORWARD COMMUNTIES WILL DEMOLISH THE BASIC STRUCTURE OF THE CONSTITUTION!
In a statement issued by Dr.K.Veeramani, President of the Dravidar Kazhagam on 3rd July, 2019 he said that provision of 10% reservation for poor people among the forward communities will demolish the basic structure of the constitution of India and it is only a prelude to change topsy turvy the principle of providing reservation for socially and educationally backward people. He has also cautioned the State Government of Tamil Nadu not to get itself caught in the bait of the Central Government promising additional seats for admission into the medical colleges.
He has requested those in favour of Social Justice to unite together to redeem the Social Justice from the well planned tactical activities of the Central BJP Government against the principle of Social Justice. He has also stated that the request of the leader of the opposition made in the Assembly to convene an all party meeting in this regard and the acceptance of the Chief Minister are matters to be welcomed. He has also urged all to work jointly in matters of general issues.
The first government of the NDA led by BJP – RSS combine under the Prime Minister Mr.Narendra Modi, which has completed its full term of five years in office, has introduced hurriedly in the last Parliament session before facing the general elections, a bill of amendment to the Constitution of India for provision of 10% reservations for poor people among the forward classes, passed the bill in both the houses of Parliament without any detailed discussion, obtained the assent of the President and became an Act.
Provision of reservation to the forward class people will destroy the basic structure of the Constitution of India
It is a plan to demolish the basic structure of the Constituion of India and the basic principle of Social Justice. We, the DMK and other organisations of Social Justice have pointed out that provision of 10% reservation solely on the basis of economic backwardness is against the basic structure of the Constitution and filed cases in the High Court of Chennai and the Supreme Court of India to declare the 103rd Constitutional Amendment invalid.
News have also come out that the Constitutional Bench of the Supreme Court of India under the leadership of the Chief Justice of India is going to take up enquiry into the matter on 30-7-2019.
What is the stage at which the two bills passed in the Tamil Nadu Assembly are standing
As the academic year is commencing, it seems that the two Bills unanimously passed in the Assembly of Tamil Nadu, seeking exemption from the perview of NEET examinations, are being kept by the Central Government without taking any action on them sofar and NEET examinations are being conducted for this year 2019- 2020 also.
It is a great irony that 5 girl students who could not get admission in medical colleges due to the NEET examinations committed suicides.
The AIADMK Government of Tamil Nadu have declared that the reservation of 10% for poor among the forward communities will not be introduced in Tamil Nadu this year. But, it seems that the Central government is giving pressure to the Government of Tamil Nadu to introduce immediately the Act providing 10% reservation, promising to allot 10% of regular seats and 25% more additional seats in Medical colleges.
Sofar the State Government of Tamil Nadu and Karnataka have not accepted to implement the scheme.
Additional seats for whom
Whatever number of additional seats are allotted to Tamil Nadu, admissions to medical colleges are going to be done on the rank list of the NEET examinations which was made compulsory. The net result will be that more number of candidates from other States will join in medical colleges of Tamil Nadu. It is a fact that the poor and simple rural students of Tamil Nadu will not get any benefit from the additional seats promised by the Central Government.We should not get ourselves cheated by the promise of additional medical seats thinking that only students of Tamil Nadu will be admitted in these seats. Do you know that there will be no reservation for OBCs in the seats allotted to the Central government from the general pool of seats received from various States?
The Tamil Nadu Government can boldly cancel the system of giving 15% of MBBS seats and 50% of post graduate seats of the medical colleges of Tamil Nadu to the pool of the Central Government and admit students from Tamil Nadu in those seats.
The 15% of medical seats given to the central pool from Tamil Nadu is not a compulsory one. It is only a concession shown by the States to the Centre. Therefore, the State Government need not give this 15% seats to the Central pool, because students from other states are getting admissions in our medical colleges is more than 15% of seats, possibly in majority of the seats in Tamil Nadu, due to the introduction of NEET examinations!

“The Central Government have announced hurriedly 10% reservations to the people of forward communities on the basis of economic backwardness, which is against the principles laid down in the Constitution of India.”
“News have also come out that if the Government of Tamil Nadu execute this schme of reservation, 25% additional medical seats will be allotted to Tamil Nadu. The Central Government is hoping that it can put honey on our tongues, the people living in the soil of the principle of Social Justice.”
Don’t let yourself be caught in the hook
Explaining in detail about the watch being kept by the Central Government whether we are getting caught in the hook they have thrown on us, the leader of the opposition emphasised the Government to conduct immediately an all party meeting for this purpose, discuss the matter in detail and take a suitable decision.

The announcement made by Chief Minister of Tamil Nadu Edappadi Mr.K.Palanisamy accepting this suggestion and announcing that an all party meeting will be conducted and decision in this problem will be taken according to the consensus is welcome!
There are only FIVE opposition parties in the Tamil Nadu Assembly now. Inviting the leaders of all important parties is a good democratic approach.
While the present AIADMK government is claiming the legacy of M.G.R. and J.Jayalalitha, we have to remember that the economic criteria for providing reservations was not accepted in the regimes of both of these leaders. The only State where an enactment was made for the provision of 69% reservation to the people of OBCs, SCs, STs, got the assent of the President and included in Schedule IX of the Constitution to protect it from the judicial review, is Tamil Nadu, the only land is the land of Dravidians – having the distinction to be called as the Land of Social Justice and the Land of Thanthai Periyar. Only to break this legacy, the Central Government is trying hard to bring the Tamil Nadu State also in the network of States providing 10% reservation for the poor among the forward communities, which is quite against the principles laid down in the Constitution of India, by giving sedated biscuits in the form allotment of additional medical seats. We should not allow ourselves to be cheated. We must be very very careful!
Other States are also getting benefits from
the attempts of the Tamil Nadu State
The system of reservation is protected all along by Tamil Nadu, once in 1951 due to the vigorous attempts made by Thanthai Periyar, when the first Constitution Amendment was brought to protect the reservation system of Tamil Nadu and again through our efforts made through the then C.M. J.Jayalalitha as 76th Constitutional Amendment, reservation in admissions in the Central education institutions provided through the 93rd Constitution Amendment by the UPA government in which the DMK led by Dr. Kalaignar was a partner. All these benefits derived from the efforts of the leaders of Tamil Nadu can be availed by the people oppressed at the country level.
The AIADMK government should not earn a bad name by supporting the plot enacted which will destroy the basis of the Social Justice itself, failing to notice – the land mines buried in between.
Let us join together in general issues
Without doing politics in this matter, let the ruling party and all the opposition parties, in order to make the flag of Social Justice to fly high, join together and take a uniform stand in this vital issue!
Let such an approach of the Government of Tamil Nadu continue in future also in all such general issues!
